"A Parent's Worst Nightmare

Alice and Miquel Velasquez were wrongfully accused of child abuse due to their infant daughter's fractures. Even after their daughter had a positive skin biopsy for Osteogenesis Imperfecta (brittle bones) the social workers and child abuse doctors refused to acknowlege it and continued to insist the child was abused. It was a long ordeal for the family but thankfully they were able to get their daughter back home. They also sued and won a settlement against the state of Virginia. Their family's story is featured in Reader's Digest which you can read online.

OI vs. Abuse Survey

We have been helping to coordinate a research project with Dr. Kocher. He is an orthopedic surgeon from Children's Hospital in Boston who has already written two medical journal articles about the difficulty of distinguishing mild osteogenesis imperfecta (OI) from child abuse. Dr. Kocher plans to write another medical article based on the family surveys. Dr. Kocher cannot know any identification info about the survey participants and that's why they're working with us to send surveys to families and then forward them back to Dr. Kocher. We hope that his article will help to better educate the medical community about mild OI. Please contact us if you would like us to mail you a copy of the survey. Please click here for an html version of the survey

Medical Information

We hope to help aid in preventing the mistaken diagnosis of child abuse from occurring when the child actually has a medical condition which has been misinterpreted to be child abuse. Medical doctors need to be fully trained with the many pediatric conditions and bone disorders, such as Osteogenesis Imperfecta and Vitamin D deficient Rickets, that can resemble child abuse in order to avoid over reporting to Child Protective Services. It is imperative that medical doctors make all efforts to rule out all potential pediatric conditions before coming to the conclusion of child abuse.

We have medical information which we are willing to provide to doctors, hospitals, and Child Protective Services in order to educate how certain symptoms, such as fractures, can be the result of a medical condition and can be mistakenly diagnosed as child abuse.

Family Support

We provide medical and legal information, as well as support, to family members who have been wrongly accused of child abuse. It is our goal to equip the families and their attorneys so they will be able to research their child's potential medical condition in order to get their child appropriate medical care and to help resolve their cases.

Legal Reform

Child Protective Services (CPS) has an important role in our society as there are abused children that need protection. CPS, however, needs to be aware that mistaken diagnosis by medical doctors can be made and thus wrongful accusations of child abuse by CPS can occur as well. It is our goal to work on legislation to change the laws that govern CPS in order to give families and children more rights and protection from false allegations.

The child has a right to be accurately diagnosed. It is not in the child's best interest to ignore that the child could potentially have a serious medical condition. It is our goal that the family be given more liberty to pursue doctor appointments during an ongoing investigation so that their child can be fully evaluated for a potential medical disease.
